Description of Services: The Golf League Network and/or Golf LeagueChampionship (herein referred to as the League System) will provide the registering golf league administrator with a username and password with which to manage league golfers. Payment Fee: The League System fee is dependent upon the number of league golfers a league administrator registers for a given league. The League System fee also includes a one-time per season administration fee. The League System may have periodic rate changes that are defined by the host Association and or Handicomp, Inc. The registered league administrator is responsible for such fees according to the terms of the League System. Once a league administrator has the ability to access the site using a username and password, the fees become non-refundable. Billing: Handicomp will appear on the registering league administrator’s credit card statement for all charges made. Electronic Receipt: Once a registered league administrator has logged in, they may at any time view or print a copy of the account charges made for the life of their access to the site. Refunds: When the league administrator requests termination, fees are not refundable. Subscription to the League System is good for 12 months at which time a subscription must be renewed. Bookmarking: The registered league administrator agrees that at any time they will not bookmark any page of the League System that will allow them to bypass the Terms and Conditions of the site upon entering. If such a bookmark exists, said bookmark will constitute full agreement to said Terms and Conditions as well as to admission that subscriber is of legal age of majority in their state, country, or region. Authorization of Use: Registered league administrators and their registered league players (collectively “users”) are authorized to access the service or materials located on the League System for a period of 12 months from the date of subscription. A user is provided access to the League System through the use of a unique username and password. Handicomp reserves the right to terminate a user’s access to the League System at any time if the terms of this agreement are breached. Transfer of Authorization of Use: Users of the League System are hereby authorized a single username and password, which shall be used to gain access to the site. Users may not under any circumstances release their username and/or password to any other person, and are required to keep his/her username and password confidential. Handicomp will not release passwords for any reason, to anyone other than the user, except as may be specifically required by law or court order. Unauthorized access is a breach of this Agreement and a violation of law. Users acknowledge that the owner of the system may track, through the use of special software, each user’s entry to the site. If any breach of security, theft or loss of username or password, or unauthorized disclosure of username and password occurs, the user must immediately notify Handicomp of said security breach. User will remain liable for unauthorized use of service until Handicomp is notified of the security breach by email or telephone. Disclaimer of Warranty: Handicomp makes no warranty of any kind, either expressed or implied, with respect to the use of the League System. Handicomp expressly disclaims all warranties of merchantability and fitness for a particular purpose. Limitation of Liability: In no event shall Handicomp be liable to the user for any damages, including lost profits, lost savings, or other incidental or consequential damages arising out of the use or inability to use the League System, even if Handicomp has been advised of the possibility of such damages. Supplementary: The League System may have additional Terms and Conditions that are an integral part of their offering to the User, and are in addition to these Terms and Conditions. Such Terms and Conditions as listed at the site will in no way invalidate any of the Terms and Conditions listed here. All Terms listed apply to Handicomp, the sites, and Users. I understand that by having Accepted the Terms and Conditions, I am affirming that I have read and understand the terms of this account and authorize Handicomp to bill my chosen payment method in accordance with the current Terms and Conditions. This Agreement is governed by the laws of the State of Michigan. Severability: If any provision of the Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any of the Agreement is invalid or unenforceable, but that by limiting such provision it would become valid or enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited. Notice: Notices given by the League System to subscribers may be given by means of electronic messages through the website, by a general posting on the site, by email, or by conventional mail. Notices by subscribers may be given by electronic messages, email, conventional mail, telephone, or fax unless otherwise specified in the Agreement. All questions, complaints, or notices regarding the site must be directed to Handicomp. All cancellations of service to the League Systems must also be directed to Handicomp.
